The Authorized Representative serves as the designated contact person for EU competent authorities and the AI Office and is responsible for supporting the provider in fulfilling its obligations under the AI Act, which also includes keeping copies of required documentation and verification of certain obligations of the AI provider.

The Authorized Representative may also be held liable under the AI Act.

Who Must Appoint an Authorized Representative under the AI Act?

Non-EU providers active on the EU market that provide their General-Purpose AI Model (GPAI) OR an AI system which can be classified as a  High-Risk AI system in the EU must appoint, in writing, an EU Authorized Representative, before placing their GPAI model or making their High-Risk AI system available on the market in the Union.

Penalties and Enforcement

Failure by a non-EU provider of high-risk AI systems or GPAI models to appoint an Authorized Representative under the AI Act may result in enforcement measures and significant administrative fines, which can result in fines of up to €15 million or 3% of the company’s worldwide annual turnover.
