Role & Responsibilities of the E-Evidence Legal Representative
under Article 3 of the E-Evidence-Directive
The E-Evidence Legal Representative serves as the designated contact person for a service provider established outside the EU and is addressee for the authorities issuing European Production Orders and European Preservation Orders for electronic evidence in criminal proceedings. Moreover, it also handles the transmission of information and data from the service provider to the competent authorities.
The applicable deadlines are very tight: In emergency cases, responses need to be provided within eight hours, and communication needs to take place via a dedicated communication system, not via email.
It is solely the service provider’s responsibility to comply with the obligations arising out of the E-Evidence-Regulation. Nevertheless, the E-Evidence Legal Representative can also be held accountable for infringements of the E-Evidence-Regulation committed by the service provider.
